A working draft, not final legal terms
These documents are being prepared for LobbyMind. They are not yet effective. Operator contact details, applicable legal requirements and the commercial terms identified below still need confirmation before publication.
Business use and contracting party
These draft terms are intended for business customers using LobbyMind to operate a hospitality property. The operator name is LobbyMind; the full contracting entity and contact details must be confirmed in the final agreement.
The person accepting an order or subscription must have authority to act for the customer. These draft pages do not create a subscription or replace an agreed order form, service agreement or data-processing agreement.
Accounts and team access
The customer is responsible for providing accurate account information, assigning appropriate access and keeping authentication credentials secure. Team members should use the access intended for their responsibilities.
The customer should remove access when responsibilities change and report suspected account misuse through the agreed support channel. Support contacts and any verification procedures must be stated in the final agreement.
Permitted use
Use the service for lawful hospitality operations and within the scope of the agreed subscription. Do not use it to submit unlawful material, access another customer’s records, interfere with the service or bypass access restrictions.
The customer remains responsible for the conduct of authorised users and for ensuring that their use of the service meets the laws and professional obligations applicable to the property.
Customer data and responsibilities
The customer retains its rights in the information it supplies. It is responsible for the accuracy of that information and for having the notices, permissions and other legal grounds needed to use guest and staff data through the service.
The scope of LobbyMind processing, confidentiality, security assistance and instructions for returning or deleting customer data must be set out in the applicable data-processing agreement. The property remains responsible for its guest relationships and operational decisions.
Fees, plans and commercial terms
The applicable order and published pricing describe the selected plan, pricing basis and included capabilities. Additional services or add-ons require the scope and price to be agreed. Do not assume that a demonstration includes a commitment to provide an unlisted feature.
Billing dates, taxes, renewals, cancellation procedures, refunds and any minimum commitment must be confirmed in the commercial agreement before purchase. This draft does not introduce a refund promise, automatic renewal term or cancellation charge.
Apps and assisted workflows
Third-party services may have their own terms, fees and availability. The customer should confirm required connections and permissions before relying on an app for an operational workflow.
Automation recipes and copilot answers serve different purposes. The current copilot reads and explains property records with citations; it does not independently change them. Users should review outputs and sources and remain responsible for decisions and actions.
Service availability and support
The agreed service scope should describe onboarding, support channels and any maintenance arrangements. Features and apps should be assessed against the customer’s actual workflows before adoption.
Any availability commitment, response time, service credit or backup and recovery obligation must be expressly agreed. This draft does not create an uptime guarantee or a service-level agreement.
Suspension, termination and data export
The final agreement must define when access may be suspended or ended, including the process for addressing misuse, security concerns or unpaid charges and any notice or remedy rights that apply.
Before ending service, the parties should agree the available export process, responsibilities, timing and any assistance charges. Data return, retention and deletion must follow the applicable agreement and law; no fixed export or deletion period is promised in this draft.
Intellectual property and legal allocation
Rights in customer data remain with the customer or the relevant rights holder. Access to LobbyMind does not itself transfer ownership of the software, product designs or branding. The final agreement should define the customer’s permission to use the service.
Warranties, liability allocation, any liability limits, indemnities, governing law and dispute-resolution arrangements remain subject to commercial and legal review. None is established by this draft, and it does not seek to exclude rights that cannot lawfully be excluded.
Changes and contact
The final agreement must identify how notices are delivered and how proposed changes to the service or terms are communicated. A confirmed version and effective date should be provided before the terms are accepted.
Operator contact details and the relevant contracting documents are still being finalised. These draft terms should be completed and reviewed before they are relied on for a purchase or service relationship.
